More patients sue for malpractice related to delays in breast cancer diagnoses than any other area of medicine. According to the Physician Insurer’s Association of America, nearly half of these claims-44%-lead to payment, according to Bonnie Rush, RT(R)(M)(QM), president of Breast Imaging Specialists, a consulting firm in San Diego.
Although the rate of claims against radiologists related to delay in diagnoses of breast cancer has remained flat over the past 10 years-despite an increase in the number of mammograms conducted-payouts in these cases have risen. Juries have awarded increasingly large amounts of money in these cases and are often motivated more by sympathy for the plaintiff than by the strength of the case itself, Rush said.
