Prepare to meet new patient restraint and seclusion requirements

At the end of 2006, the Centers for Medicare & Medicaid Services (CMS) updated its Patient Rights Condition of Participation (CoP) with new requirements for patient restraint and seclusion. The new rule is effective as of February 6, 2007 and focuses on the rights of patients to be free from inappropriate use of restraint and seclusion.

This latest update demonstrates CMS' efforts to discourage restraint use except when absolutely necessary and only after all other less restrictive methods have been exhausted. According to the final rule, CMS has combined the use of restraint for medical/surgical reasons and restraint use for behavioral health reasons into one CoP. The updated includes additional expectations for staff training, reporting of deaths due to restraint and seclusion, face-to-face evaluations, and many more changes.
