The landmark $377 million jury verdict against peer review participants in the 2003 Poliner case has been overturned. What does this decision mean for peer review?
The Poliner case captured the attention of hospitals, medical staffs, and physicians nationwide when a jury awarded Dr. Lawrence Poliner $377 million in damages as a result of a peer review committee’s decision to suspend his clinical privileges.
Although a trial court later reduced that amount to approximately $33 million, the case introduced complex questions and concerns about the continued availability of peer review immunity protections under the Health Care Quality Improvement Act of 1986 (HCQIA). Last month, the U.S. Court of Appeals for the Fifth Circuit overturned the jury and the trial court’s decisions and found in favor of Texas Health System and the physician defendants, concluding that the physicians who advocated for Poliner’s suspension are immune from court damages under HCQIA. As a result, Poliner will not receive any monetary award for damages. However, the questions raised by the case have not yet been answered.

MEET THE SPEAKERS
Michael R. Callahan, JD, is a senior partner in the healthcare practice group in the Chicago office of Katten Muchin Rosenman LLP.
