Industry support of continuing medical education (CME) is not only acceptable, it can be appropriate. However, it also has the potential to introduce commercial bias that threatens the integrity of the CME event or publication. To reduce the risk of bias, PhRMA, the OIG, the FDA, and the American Council for Continuing Medical Education (ACCME) have created guidance applicable to industry support of CME.
The rules and guidance surrounding industry support for CME are constantly evolving. The revised PhRMA Code on Interactions with Healthcare Professionals reinforces the OIG's 2003 recommendation that companies separate their grant-making department from sales and marketing. In addition, some states are now requiring compliance with the PhRMA Code and OIG guidance. In the wake of Congressional criticism, some companies are disclosing their grants, while academic institutions are revising their criteria for accepting industry support for CME.

Kathleen Peterson, Esq., Health Care and Life Sciences, Epstein Becker & Green. Ms. Peterson is a senior associate in her firm's Washington, D.C., office, and practices in the Pharmaceutical Industry Health Regulatory Group. Her work experience includes providing health regulatory counsel to pharmaceutical manufacturers, distributors, PBMs, managed care organizations, GPOs, and investment firms on a wide range of legal issues.
Betsy S. Woodall, PharmD, MBA, BCPS, Associate Director in Independent Medical Education, Wyeth Pharmaceuticals. Dr. Woodall is responsible for the strategic alignment of evidence-based independent education grants with the scientific interests of patients, healthcare professionals, and Wyeth, specific to Alzheimer's disease, rheumatoid arthritis, constipation, and vaccines.
